General Terms and Conditions (GTC)
General
DermaCircle.ch™ is the online shop of Difamed GmbH (hereinafter referred to as “Difamed”) a Swiss Limited Liability Company with registered office in 6873 Corteglia, Switzerland.
The following General Terms and Conditions (GTC) apply to all services provided by Difamed and become binding for the purchaser (hereinafter referred to as “customer”) when an order is placed on DermaCircle.ch™. The GTC apply to all contracts, deliveries, or other services. Deviating agreements or ancillary agreements require the written confirmation of Difamed.
The offer of DermaCircle.ch™ is limited to Switzerland and Liechtenstein and the orders are shipped only within this geographical area.
Difamed is entitled to change the GTC at any time. The version valid at the time the order is placed on DermaCircle.ch™ applies to the customer.
Registration / Data Protection
Registration at DermaCircle.ch™ is reserved exclusively for persons who are at least 18 years old, legally capable of acting and making decisions.
The customer must provide the data required for registration completely and truthfully. The customer is responsible for updating their data. Difamed is not liable for issues arising from outdated or incorrect information provided by the customer.
The provisions of Difamed privacy policy apply to data protection and form an integral part of these GTC. For further information please see the Privacy Policy.
Delivery and Shipping Cost
The goods are distributed through Swiss Post AG. Delivery is usually within 2 (two) working days (Monday to Friday). Orders placed on Saturday or Sunday are usually delivered the following Tuesday.
For orders above 70.00 CHF Difamed will offer PostPac Economy shipping free of charge. For orders below 70.00 CHF Difamed will charge 10.50 CHF (PostPac Economy shipping).
In the event of loss, damage or incorrect delivery of the shipment, Swiss Post AG is liable as indicated in the Swiss Post General Terms and Conditions (www.post.ch).
Delivery period
Due to delivery or production bottlenecks, unexpected delivery delays can occur. These delays do not entitle the customer to any form of compensation and Difamed accepts no liability in connection with shipping.
Transfer of risk
The risks are transferred from Difamed to the customer when the goods are dispatched. The customer assumes responsibility for the goods upon dispatch, regardless of whether the customer personally receives the delivery.
Prices
The product prices stated on DermaCircle.ch™ at the time the customer places their order is binding. All prices are in Swiss francs including VAT.
Retention of Title
The goods remain the property of Difamed until the delivered goods have been paid for in full.
Right of Return / Withdrawal
Difamed grants the customers the right to return products purchased from DermaCircle.ch™ within 14 (fourteen) days of receipt. It is not necessary to state a reason for the return. The time of dispatch of the goods is decisive for compliance with the deadline. A customer who wishes to exercise this right should inform Difamed of the decision to withdraw from the purchase contract within the above-mentioned period. The best way to do so is to contact Difamed at sales@dermacircle.ch or by phone at +41 91 682 81 13.
Returned products or packages will only be accepted if they are in good condition, i.e. undamaged, unused, unopened and in the original packaging. If the returned products are in unacceptable condition, no refund will be issued. The customer is responsible for paying the return shipping costs.

Warranty
The warranty terms of the product manufacturer apply. These are included with the products.
The products sold by Difamed on DermaCircle.ch™ are to be used as part of a skin treatment with the consent of the person being treated. Prior clarifications for the treatment are to be conducted by experts. Difamed accepts no liability for the use of the products supplied and does not provide any further warranty.
Difamed guarantees that the goods sold do not have any product defects at the time of transfer of risk. If a product defect is nevertheless discovered upon arrival of the goods, Difamed must be informed in writing within 14 (fourteen)) days at sales@dermacircle.ch. The goods in question must be returned, in their original packaging with a copy of the invoice or of the delivery note, to Difamed GmbH – Casella Postale 24 – 6874 Castel San Pietro.
The warranty provided is valid exclusively for the replacement of goods.
Products Offered
Difamed strives to keep the product images and ingredient lists on DermaCircle.ch™ as accurate as possible. However, because packaging and ingredients are subject to change, Difamed cannot guarantee that these images and lists are complete, up-to-date, and/or error-free. For an accurate listing of ingredients in each product, the customer must refer to the product packaging. In any case, the customer is required to read the specific product information and instructions of use on the product packaging before use, particularly if they suffer from allergies or sensitivities, and to consult a healthcare provider if uncertain about product suitability.
Trademarks and Brand Names
The logos, brands, product names and registered trademarks (® ™) of the products presented on DermaCircle.ch™ are the property of the manufacturers of the products and/or their affiliates and associated companies.
Limited Time Offer
Limited time offers (sales) are only valid until stocks last. The customer cannot claim compensation or other legal remedies if the product on sale is out of stock during a sale.
Quantity Restriction
Difamed reserves the right to limit the delivery quantities for the product ordered in case of limited stock, high demand or in any other case at the sole discretion of Difamed.
Force Majeure
Difamed will not be liable if unable to perform to the extent caused by a condition (for example, natural disaster, pandemic, act of war or terrorism, riot, labour condition, governmental action, and Internet disturbance, etc.) that is beyond Difamed’s reasonable control.
Severability
The provisions of these GTC shall be deemed severable and the invalidity or unenforceability of any provision shall not affect the validity or enforceability of the other provisions hereof.
If any provision of this agreement or its application to persons and circumstances is invalid or unenforceable, the remaining provisions will continue to have effect.
Languages, Applicable Law, and Jurisdiction
The whole terms of these GTC have been provided in English and in case of translation discrepancies, for disputes and for legal purposes, the text in English is to be given priority of interpretation.
These GTC are subject exclusively to the Swiss Code of Obligations and other norms enacted by Swiss law.
The exclusive place of jurisdiction for all disputes between Difamed and the customer is the registered office of Difamed. Alternatively, Difamed may refer to the customer’s place of residence.
